Welcome to the Aroma Archive website (the “Site”). Aroma Archive provides you the right to access and use the Site, including all Content, products, and services available on the Site (collectively with the Site, the “Offerings”), subject to these Terms and Conditions, our Privacy Policy (accessible here), and any additional terms referenced herein and/or terms you agree to prior to being granted access to certain areas of the Site (collectively, the “Terms”). These Terms govern your use of our Site and your conduct, irrespective of your means of access, whether from a computer, mobile phone, or other device.

These Terms apply to any website or document that links to these Terms.

These Terms constitute a legally binding agreement between you and Aroma Archive (collectively, the “Parties”). Please read them carefully before accessing or using any of our services or offerings. By accessing or using any part of the Aroma Archive website or services, or by clicking a box indicating your acceptance of these Terms and Conditions, you confirm that you have read, understood, and agree to be bound by them. This includes your consent to the collection and use of your information as described in our Privacy Policy.

If you do not agree to these Terms, or do not meet the requirements outlined herein, you are not permitted to access or use any Aroma Archive offerings.

ARBITRATION AGREEMENT

These Terms include provisions that govern how disputes between you and Aroma Archive and/or its affiliates will be resolved. In particular, the Arbitration Agreement in Section 22 requires that, with limited exceptions, all disputes must be resolved through individual, binding, and final arbitration, unless you choose to opt out.

Additionally:

You and Aroma Archive may only bring claims on an individual basis and not as part of any class action or representative proceeding.
You are waiving your right to a court trial or jury trial for any claims covered by this agreement.

Please review Section 22 carefully to understand your rights and obligations before using any Aroma Archive offerings.

1. DEFINITIONS

Capitalized terms used in these Terms shall have the meanings assigned to them within the context in which they appear. All other terms shall carry their ordinary meaning in standard U.S. English.

2. ELIGIBILITY

You may only access or use Aroma Archive’s offerings if you are 18 years of age or older and meet all other eligibility criteria specified in these Terms. By using our site or services, and by agreeing to these Terms, you confirm that you satisfy all eligibility requirements. If you do not meet any of these conditions, you may not access or use any of Aroma Archive’s offerings. Our services are not available to any individual previously removed or restricted from use by Aroma Archive.

3. MODIFICATIONS

Aroma Archive reserves the right, at any time and at our sole discretion, to modify or discontinue any part of our offerings, with or without prior notice. We may also update or revise these Terms at any time. Changes to our Privacy Policy will be made in accordance with the provisions stated within that policy.

We will notify you of any updates to the Terms by posting the revised version on our website. All modifications will become effective immediately upon posting. If you do not agree with the updated Terms, you may discontinue your use of our offerings. Continued use of the site or services after changes have been posted will constitute your acceptance of the updated Terms.

6. PRODUCTS AND SERVICES FOR PERSONAL USE

The products and services offered through the Aroma Archive website, including any samples provided, are intended for personal and/or professional use only. You may not sell, resell, or otherwise exploit any products, services, or samples received from Aroma Archive for commercial purposes.

We reserve the right, at our sole discretion and without prior notice, to cancel or limit the quantity of any order that we believe may breach these Terms, including suspected commercial resale. Purchases made through your online account, at Aroma Archive boutiques, or via telephone orders may be tracked to ensure compliance with these Terms.

7. ACCURACY OF INFORMATION

While Aroma Archive strives to ensure the accuracy of all product descriptions, imagery, color representations, and content presented on our website, we do not guarantee that such information is always complete, current, reliable, or free of errors.

The website may occasionally contain typographical errors, inaccuracies, or omissions. We reserve the right to correct such errors—including those related to pricing or availability—at any time, without prior notice, even after an order has been submitted. We also reserve the right to cancel or refuse any order placed based on incorrect information. We apologize for any inconvenience and appreciate your understanding.

8. TERMINATION

Except as otherwise stated in this Section, either you or Aroma Archive may terminate these Terms at any time, at your or our sole discretion, by providing notice in accordance with the communication methods outlined in these Terms.

Upon termination or expiration of these Terms for any reason, you must immediately discontinue all access to and use of the Offerings, including any content acquired prior to termination. Termination does not release you from any outstanding payment obligations for products or services purchased prior to the termination date.

Any provisions of these Terms that by nature should survive termination—such as ownership rights, disclaimers, indemnities, and limitations of liability—will continue to apply after the agreement ends.

9. YOUR OBLIGATIONS AND RESPONSIBILITIES

By accessing or using the Offerings, you agree to comply with these Terms, as well as any specific instructions, guidelines, or warnings displayed on the site. You must use the Offerings in accordance with applicable laws, established practices, and principles of good faith.

10.2 Linking to the Site

You may create a hyperlink to the homepage of the Aroma Archive website for personal, non-commercial use only, provided that your website:
(a) does not reproduce any Aroma Archive content,
(b) does not imply an affiliation with or endorsement by Aroma Archive,
(c) does not misrepresent your relationship with us,
(d) does not include content that is offensive, illegal, or otherwise inappropriate,
(e) does not present Aroma Archive or its products in a misleading or defamatory manner, and
(f) does not link to any page other than the homepage without prior written consent.

We reserve the right to request the removal of any link to our Site at our sole discretion. Upon such request, you must immediately remove the link and cease linking, unless expressly authorized in writing to resume.

10.3 Access to Content

You may be granted access to various types of content through the Site, including text, images, audio, video, graphics, logos, icons, trademarks, and other materials (“Content”). All Content, except where otherwise noted as user-generated, is the property of Aroma Archive or its licensors and is provided for informational purposes only.

(c) remove or obscure any copyright, trademark, or other proprietary notices;

YOU AGREE THAT AROMA ARCHIVE WILL NOT BE LIABLE FOR ANY CONTENT YOU FIND OFFENSIVE, INACCURATE, OR OTHERWISE OBJECTIONABLE, AND YOU HEREBY WAIVE ANY CLAIMS RELATING TO SUCH CONTENT.

10.4 Use Restrictions

The Offerings provided by Aroma Archive contain proprietary and confidential information. You agree not to, and will not allow any third party to:

Use the Offerings for any purpose other than personal, non-commercial use;

Impersonate others, share access credentials, or misrepresent your identity;
Use the Offerings in a way that competes with Aroma Archive or causes commercial harm;
Overload, interfere with, or attempt to disrupt the integrity of our servers, network, or services;

Any unauthorized use of the Offerings will immediately terminate the rights granted to you under these Terms and may result in legal action.

11. YOUR ACCOUNT

Subject to the age requirements outlined in these Terms, you may browse and use many features of the Aroma Archive website without registering. However, access to certain areas or functionalities may require the creation of a personal account (“Account”).

You may only register for an Account if you are 18 years of age or older. Approval of your Account registration is at Aroma Archive’s sole discretion. Each Account is personal and may not be shared. You are solely responsible for maintaining the confidentiality of your Account credentials (“Account ID”) and for all activities that occur under your Account.

You agree to keep your Account information accurate, complete, and current. If you suspect that your Account ID has been lost, stolen, or compromised, you must notify us immediately.

You may cancel your Account at any time. Aroma Archive reserves the right to suspend or terminate Accounts—without prior notice—if these Terms are violated, or if we determine such action is in our best interest. We are not responsible for any losses that result from unauthorized Account use.

12. YOUR CONTENT

You are solely responsible for any content, materials, or information that you submit, upload, post, share, or otherwise make available through the Site (“Your Content”), including but not limited to submissions via forms such as “Contact Us.”

While you retain ownership of Your Content, by submitting it to Aroma Archive, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and assignable license to use, reproduce, modify, adapt, translate, publish, display, distribute, and create derivative works from Your Content in any form or media, now known or later developed. This includes using Your Content in connection with Aroma Archive’s products, services, communications, or promotional materials. No compensation or acknowledgment is required unless otherwise agreed in writing.

By submitting Your Content, you confirm that you own or have the necessary rights and permissions to grant the license above. You further agree that Your Content:

Is not unlawful, threatening, abusive, defamatory, obscene, or otherwise offensive;
Does not violate any third-party rights, including copyright, trademark, or privacy rights;
Is not knowingly false, misleading, or submitted in exchange for compensation from a third party;
Is not spam, advertising, or promotional content;
Does not contain harmful code, such as viruses or malware.

Aroma Archive reserves the right—but not the obligation—to review, edit, refuse, or remove any of Your Content at our sole discretion and without notice. We may remove content that violates these Terms, infringes the rights of others, or is otherwise deemed inappropriate. Repeated violations may result in Account suspension or termination.

13. DELETION OF YOUR CONTENT

You may request the removal of certain content you have submitted to public areas of the Site—such as product reviews or comments—by contacting us at customercare@aromaarchive.com. To process your request, please include your first and last name, username (if applicable), the email address associated with your Account, a brief explanation for the request, and the date(s) of the content you wish to delete.

Please note that we may not be able to process your request if the required information is incomplete. All deletion requests are subject to Aroma Archive’s approval, which may be granted or denied at our sole discretion. Please allow up to 10 business days for your request to be reviewed and processed.

14. SPECIAL FEATURES, PROMOTIONS, FUNCTIONALITY & EVENTS

From time to time, Aroma Archive may offer special features, promotional campaigns, or interactive events—such as contests, giveaways, or exclusive experiences—either directly or in collaboration with third-party partners.

These offerings may be governed by additional or separate terms, rules, or policies. Where applicable, we will inform you of such terms in advance. By choosing to participate in these features or promotions, you agree to be bound by any supplemental terms that may apply.

16. TEXT MESSAGING

By opting in to receive SMS and/or MMS messages from Aroma Archive, you consent to receive messages regarding updates, marketing, promotions, or other brand-related communications. These messages may be sent via automated systems.

Consent to receive messages is not required to make a purchase. Message frequency may vary. Standard message and data rates may apply depending on your mobile carrier.

You can opt out at any time by texting STOP, or text HELP for assistance. After sending STOP, you may receive one final confirmation message. Aroma Archive is not responsible for any delays or undelivered messages, and mobile carriers are not liable for message delivery.

17. INTELLECTUAL PROPERTY

Aroma Archive retains all rights, title, and interest—including, without limitation, all Intellectual Property Rights—in and to its offerings, including any updates, enhancements, improvements, or modifications. The Aroma Archive name, logo, and all associated product and service names are trademarks or registered trademarks of Aroma Archive and/or its licensors. These Terms do not grant you any license or rights to use any of these marks without express written permission.

For the purpose of these Terms, “Intellectual Property Rights” refers to all intellectual property and proprietary rights of any kind worldwide, including (but not limited to) copyrights, trademarks, service marks, trade secrets, patents, design rights, rights of publicity and privacy, moral rights, rights in data and databases, and all other rights protecting intangible assets.

Except for the limited access rights expressly provided in these Terms, you receive no ownership or license rights in or to any part of the Aroma Archive offerings. You may not copy, reproduce, modify, distribute, sell, or otherwise exploit any part of the Site or its content without our prior written consent.

Feedback Submissions:
Any suggestions, feedback, comments, or materials you submit to Aroma Archive—whether through the Site, by email, or otherwise—will be treated as non-confidential and non-proprietary. Unless prohibited by law, you hereby assign to us all rights, title, and interest in any such Feedback, including any related intellectual property rights. We are free to use, without attribution or compensation to you, any ideas, know-how, concepts, or techniques included in such Feedback for any purpose, including (but not limited to) developing, manufacturing, licensing, or marketing products and services.

If an assignment of rights is not permitted under applicable law, you instead grant us an exclusive, royalty-free, worldwide, perpetual, and fully sublicensable license to use and commercialize your Feedback in any manner we deem appropriate. 18. COPYRIGHT INFRINGEMENT NOTICES

Aroma Archive respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, users who repeatedly infringe on the copyrights of others.

Identification of the copyrighted work(s) claimed to have been infringed;

19. DISCLAIMER OF WARRANTIES

All offerings and content provided by Aroma Archive are presented “as is” and “as available.” We, along with our parent company, subsidiaries, affiliates, partners, and licensors, make no representations or warranties—express, implied, or statutory—regarding the Site, the Offerings, or their availability, reliability, or functionality.

We expressly disclaim any and all warranties, including but not limited to:

Implied warranties of merchantability,
Fitness for a particular purpose,
Title, and
Non-infringement of intellectual property rights.

You agree that neither Aroma Archive nor its affiliates or licensors shall be liable for any of the following, regardless of the cause:

Business interruptions or delays;
Access disruptions or performance issues related to the Site;
Data loss, corruption, misdelivery, or destruction;
Damages resulting from interactions with third-party links or content;
Computer viruses, malware, or system failures that may occur in connection with the Site;
Errors, inaccuracies, or omissions in any content;
Events beyond our reasonable control.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, neither Aroma Archive nor our affiliates, licensors, or partners shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages—including loss of profits, revenue, business opportunities, or data—arising from your use of or inability to use the Offerings, even if we have been advised of the possibility of such damages.

Our total cumulative liability in connection with these Terms and any Offerings provided shall not exceed the greater of:

The total amount paid by you to Aroma Archive in the three (3) months preceding the event giving rise to the liability

You acknowledge that this limitation of liability is a material condition of your agreement with us, and that Aroma Archive would not enter into these Terms without it. In jurisdictions where the limitation or exclusion of liability is restricted, we limit our liability to the maximum extent permitted by law.

21. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Aroma Archive, along with our officers, directors, employees, agents, contractors, licensors, affiliates, successors, and assigns (“Indemnified Parties”), from and against any and all losses, liabilities, claims, damages, costs, and expenses (including reasonable attorneys’ fees and legal costs) arising from any third-party claims related to:

Your access to or use of any Offering;
Any content you submit, post, or share (“Your Content”);
Your violation of these Terms;
Your breach of any applicable laws, rules, or regulations;
Your misconduct or misuse of the Site;
Any use of your account or credentials by another individual with or without your knowledge.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with our defense of such claim.

22. DISPUTES & ARBITRATION

In the event of any dispute, claim, or controversy arising out of or relating to your use of the Site, purchases made through the Site, or these Terms, both you and Aroma Archive agree to first attempt to resolve the matter amicably.

If a resolution cannot be reached informally, the dispute will be submitted to final and binding arbitration, conducted by a single arbitrator, in accordance with the rules of a recognized arbitration body in Lebanon. The arbitration shall take place in Beirut, Lebanon, and the proceedings shall be conducted in English or Arabic, as mutually agreed by the parties.

By agreeing to arbitration, both parties waive the right to bring claims before a court, including the right to a jury trial, except where such waiver is not permitted by law. Claims related to intellectual property rights, or where injunctive or equitable relief is sought, may still be brought before a court of competent jurisdiction.

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of Lebanon, without regard to its conflict of laws principles.

23. NOTICE

By using the Site or any of our Offerings, you consent to receive all legal communications, agreements, and notices (“Notices”) from Aroma Archive electronically. Notices may be sent via email or posted directly on the Site.

Such electronic Notices satisfy any legal requirement that communications be in writing. If you wish to withdraw your consent to receive Notices electronically, please contact us at customercare@aromaarchive.com. Please note that withdrawal of consent will result in your loss of access to the Offerings, as we cannot provide services without electronic communication consent.

Your marketing communication preferences are separate and governed by our Privacy Policy.

24. GENERAL

You acknowledge and agree that these Terms represent the entire and exclusive agreement between you and Aroma Archive regarding your use of the Site and Offerings, and supersede all prior agreements, understandings, or communications, whether written or oral.

Nothing in these Terms shall be construed as creating a partnership, joint venture, or agency relationship between you and Aroma Archive. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other rights we may have.

If any provision of these Terms is held to be invalid or unenforceable by a court or arbitral body, the remaining provisions shall remain in full force and effect. Where possible, any unenforceable term will be replaced with one that reflects the original intent of the parties.

Headings in these Terms are for convenience only and do not affect interpretation. All rights and remedies under these Terms are cumulative.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any unauthorized assignment shall be deemed null and void. Aroma Archive may assign its rights and obligations under these Terms at any time and without notice.
